Agreement to these terms

These Terms of Use (the "Terms") are an agreement between you and Andrew Gilfillan, d/b/a Texas Binairo ("we", "us" or "our"), and govern your use of the Texas Binairo mobile application and any related website (together, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

If you downloaded the App from the Apple App Store, the Apple Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. If these Terms conflict with that agreement, that agreement controls to the extent required by Apple.

The App

Texas Binairo is a logic puzzle game based on the binary puzzle format, in which you fill a grid with two symbols according to a set of rules. We may add, change, or remove puzzles and features at any time.

Subscriptions and free trials

Some features of the App require a paid subscription. Subscription options, prices, and any free-trial length are shown in the App before you buy.

All purchases are processed by Apple. Refund requests are handled by Apple under its policies, and we cannot issue refunds directly.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for your own non-commercial entertainment, subject to these Terms.

You agree not to copy, modify, distribute, sell, or lease any part of the App; reverse engineer or attempt to extract the App's source code, except where the law allows it; use the App for any unlawful purpose; or interfere with or disrupt the App.

Ownership

The App, including its puzzles, graphics, design, and code, is owned by us or our licensors and is protected by intellectual property laws. Except for the license above, these Terms do not give you any rights in the App.

No affiliation

Texas Binairo is an independent product. It is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation or its Tango game, or by any other puzzle publisher. All trademarks belong to their respective owners.

Privacy

Our Privacy Policy explains how we handle information when you use the App. You can read it at https://sunriseapplications.com/texas-binairo/privacy/.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the twelve months before the claim arose.

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.

Termination

We may suspend or end your access to the App if you violate these Terms. You may stop using the App at any time by deleting it from your device. Deleting the App does not cancel a subscription; see "Subscriptions and free trials" above.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the App will be resolved in the state or federal courts located in Texas, unless the law of your place of residence requires otherwise.

Changes to these terms

We may update these Terms from time to time. When we do, we will post the new version on this page and update the date at the top. If you keep using the App after changes take effect, you accept the updated Terms.
